We present and discuss the responses to a survey we sent to selected libraries regarding their decisions to accept unsolicited book donations, especially regarding any with an apparent political or proselytizing intent.

Explaining that such concepts are less monolithic than some have claimed, Gracyk writes:While popular musicians often "pick up" the music of other cultures, (...) such practices are culturally, politically, and morally complex. In discussing such issues, I hope to show that they are even more complex than is typically thought. Here, I borrow an insight from Michelle Moody-Adams, who argues that prevailing positions in social and cultural anthropology assume that cultures are internally integrated wholes and that each culture is fundamentally a set of self-contained and discrete practices and beliefs. The same assumptions infest discussions of appropriation in cultural studies, folk-lore studies, and ethnomusicology. But these assumptions are highly questionable.1Gracyk's overall point is that what has frequently been simplified as "theft" or "inauthentic" is not susceptible to such easy formulation; indeed, Gracyk contends there is scarcely such a thing as a pure musical tradition.Gracyk's sophisticated argument is one, however, that itself admits of gradations and emendations. While it is no doubt accurate that there is very little that might count as artistically or culturally pure (hence, very little that can justifiably be claimed to have been stolen), some work is much more evocative of a cultural point of view than other efforts, and some work is much more centrally located within a given culture and its traditions than other musical work. In this article we shall make the twofold argument that much of the work of Scott Joplin is located in a tradition that is manifestly African derived, and that the composition of such work had, as one of its motivators, the desire to make a cultural statement. Thus, more so than some of Gracyk's exemplars, Joplin's work is strongly culturally attached, and its attachment needs to be duly noted.IThe origins of Joplin's work speak to the concerns of the nineteenth century and of the period immediately subsequent to emancipation. Most of [End Page 94] the black leadership of the time was united in its belief that a nationalist art would serve in the reconstruction of the image of African Americans. During the latter part of the nineteenth century many of these leaders saw the spiritual as the ideal folkloric basis for a serious black artistic expression. In music this notion was given strong support as a result of a concurrent interest on the part of European composers in African American music—an interest fed by the aesthetic of romanticism, which encouraged artistic investment in the strange, unusual, primitive, and exotic.Most classically trained African American composers attempted to comply with the vision of these black leaders by constructing a more or less European-style music tinctured with African American folk elements. The result would be a set of works that to this day has failed to be adopted by the African American community at large.Scott Joplin tried a different approach. He sought to create an African American musical expression that would be predicated upon an African American vernacular style—ragtime. Joplin essentialized his music in many ways. First, by choosing ragtime as a stylistic paradigm he assured the preservation of black rhythm. Second, to promote continuity and coherence he often employed rhythmic relationships between contrasting sections. Third, he frequently employed African American folk idioms like pentatonicism and call-and-response (antiphony) as interregnal devices in the structure of his melodies. Fourth, to assure an intrastructural linkage with the African American vernacular music of his day, he frequently used phrase structures that were consistent with those employed in folk music, particularly the black spiritual, for example, aaab. In his opera, Treemonisha, he based his libretto largely on black dialect, thus linking it with black literary tradition. Two Kinds of Vagueness When signing up for insurance benefits at my job, I was asked, “Do you have children, and if so are they young enough to be included on your policy?” I replied that I had two children, both of whom were over 21. The benefits officer responded, “That’s too vague. In some circumstances children of covered employees are eligible for benefits up to their 26th birthday. I need their ages to determine whether they can be included on (...) your policy.” She was right; my remark was too vague. The information it provided was insufficiently specific to advance our common conversational purpose. However, it was not vague, or at any rate not too vague, in the sense in which philosophical logicians and philosophers of language study vagueness. Vague predicates – like ‘old’, ‘bald’, ‘rich’, and ‘red’ – are those for which there are “borderline cases” separating things to which the predicate clearly applies from those to which it clearly does not. When o is a borderline case for a predicate P, there is, in some sense, “no saying” whether or not the proposition expressed by  That/he/she/it is P (said demonstrating o) is true. According to some theories of vagueness, the proposition is undefined for truth, or untruth, and so can’t correctly be characterized either way. According to others, it is true or false -- even though it is impossible, in principle, to know which. On still other theories, it is only partially true (or true to some degree). For present purposes we needn’t worry about which of these theories is correct, or which is most illuminating in discussions of the law. The present point is simpler. The problem with my remark to the benefits officer – the sense in which it was too vague – is not a matter of its susceptibility to borderline cases. What I stated, on December 10, 2009, was that my two children were both over 21 years old then. That statement is true if and only if both were born on or before.... (shrink)

This book analyses the straw man fallacy and its deployment in philosophical reasoning. While commonly invoked in both academic dialogue and public discourse, it has not until now received the attention it deserves as a rhetorical device. Scott Aikin and John Casey propose that straw manning essentially consists in expressing distorted representations of one's critical interlocutor. To this end, the straw man comprises three dialectical forms, and not only the one that is usually suggested: the straw man, the weak (...) man and the hollow man. Moreover, they demonstrate that straw manning is unique among fallacies as it has no particular logical form in itself, because it is an instance of inappropriate meta-argument, or argument about arguments. They discuss the importance of the onlooking audience to the successful deployment of the straw man, reasoning that the existence of an audience complicates the dialectical boundaries of argument. Providing a lively, provocative and thorough analysis of the straw man fallacy, this book will appeal to postgraduates and researchers alike, working in a range of fields including fallacies, rhetoric, argumentation theory and informal logic. Pursuing Justice in Africa focuses on the many actors pursuing many visions of justice across the African continent--their aspirations, divergent practices, and articulations of international and vernacular idioms of justice. The essays selected by editors Jessica Johnson and George H. Karekwaivanane engage with topics at the cutting edge of contemporary scholarship across a wide range of disciplines. These include activism, land tenure, international legal institutions, and post-conflict reconciliation. Building on recent work in sociolegal studies that foregrounds justice over and above (...) concepts such as human rights and legal pluralism, the contributors grapple with alternative approaches to the concept of justice and its relationships with law, morality, and rights. While the chapters are grounded in local experiences, they also attend to the ways in which national and international actors and processes influence, for better or worse, local experiences and understandings of justice. Nearly all psychological research on basic cognitive processes of category formation and reasoning uses sample populations associated with large research institutions in technologically-advanced societies. Lopsided attention to a select participant pool risks biasing interpretation, no matter how large the sample or how statistically reliable the results. The experiments in this article address this limitation. Earlier research with urban-USA children suggests that biological concepts are thoroughly enmeshed with their notions of naive psychology, and strikingly human-centered. Thus, if children are to develop (...) a causally appropriate model of biology, in which humans are seen as simply one animal among many, they must undergo fundamental conceptual change. Such change supposedly occurs between 7 and 10 years of age, when the human-centered view is discarded. The experiments reported here with Yukatek Maya speakers challenge the empirical generality and theoretical importance of these claims. Part 1 shows that young Maya children do not anthropocentrically interpret the biological world. The anthropocentric bias of American children appears to owe to a lack of cultural familiarity with non-human biological kinds, not to initial causal understanding of folkbiology as such. Part 2 shows that by age of 4-5 Yukatek Maya children employ a concept of innate species potential or underlying essence much as urban American children seem to, namely, as an inferential framework for understanding the affiliation of an organism to a biological species, and for projecting known and unknown biological properties to organisms in the face of uncertainty. Together, these experiments indicate that folkpsychology cannot be the initial source of folkbiology. They also underscore the possibility of a species-wide and domain-specific basis for acquiring knowledge about the living world that is constrained and modified but not caused or created by prior non-biological thinking and subsequent cultural experience. Presenting the first book-length study in English of Aristotle's Sophistical Refutations, this work takes a fresh look at this seminal text on false reasoning.

This paper re-examines the well-known problem of how it is possible to have an “intuition of absences” in Sartre’s example of Pierre. I argue that this problem is symptomatic of an overly theoretical interpretation of Sartre’s use of intentionality. First, I review Husserl’s notion of evidence within his phenomenology. Next, I introduce Sartre’s Pierre example and highlight some difficulties with interpreting it as a problem of perception. By focusing on Sartre’s notion of the project, I argue instead that the problem (...) is better understood at the level of action. In support of this interpretation, I conclude with a brief comparison to the early work of Paul Ricoeur. By borrowing some of Ricoeur’s phenomenological vocabulary tailored to action, I reinterpret Sartre’s example as a practical problem. (shrink)

Can moral philosophy alter our moral beliefs or our emotions? Does moral scepticism mean making up our own values, or does it leave us without moral commitments at all? Is it possible to find a basis for ethics in human nature? These are some of the main questions explored in this volume, which is devoted to the ethics of the Hellenistic schools of philosophy. Some of the leading scholars in the field have here taken a look at the bases of (...) the Stoics' and Epicureans' thinking about what the Greeks took to be the central questions of philosophy. Their essays, which originated in a conference held at Bad Homburg in 1983, the third in a series of conferences on Hellenistic philosophy, propose important interpretations of the texts, and pose some fascinating problems about the different roles of argument and reason in ancient and modern moral philosophy. What follows is a taxonomy of arguments that regresses of inferential justification are vicious. They fall out into four general classes: conceptual arguments from incompleteness, conceptual arguments from arbitrariness, ought-implies-can arguments from human quantitative incapacities, and ought-implies can arguments from human qualitative incapacities. They fail with a developed theory of "infinitism" consistent with valuational pluralism and modest epistemic foundationalism.

Three forms of the straw man fallacy are posed: the straw, weak, and hollow man. Additionally, there can be non-fallacious cases of any of these species of straw man arguments.

Plato and Aristotle used moral philosophy to influence the way people actually live. Focusing on the Republic and the Nicomachean Ethics, this book examines how far they thought it could succeed in this.

Recourse to meta-argument is an important feature of successful argument exchanges; it is where norms are made explicit or clarified, corrections are offered, and inferences are evaluated, among much else. Sadly, it is often an avenue for abuse, as the very virtues of meta-argument are turned against it. The question as to how to manage such abuses is a vexing one. Erik Krabbe proposed that one be levied a fine in cases of inappropriate meta-argumentative bids (2003). In a recent publication (...) (2022) Beth Innocenti expands on this notion of a penalty, arguing that some meta-arguments should be halted with “shouting, cussing, sarcasm, name-calling.” In this essay, we review Innocenti’s case that these confrontations and haltings improve the argumentative circumstances. We provide three reasons that this promise is not well-founded. First, that such confrontations have a significant audience problem, in that they are more likely to be interpreted as destroying the argumentative context than improving it. Second, that Innocenti’s procedural justification, that those who lose meta-discussions should pay a penalty, is not satisfied if the meta-discussion is halted. And third, there is a boundary problem for the cases, since it seems there is no principled reason to restrict halting meta-arguments just to these cases (especially if there is no meta-discussion on the matter to make the bounds explicit). Though expressions of anger can be appropriate in argument, we argue, it cannot take the place of argument. (shrink)

Hospitals and businesses regularly utilize the services of ethics consultants—experts who help resolve ethical problems/dilemmas, provide guidance concerning ethical issues, and assist in the development of policies designed to increase the likelihood that ethically difficult or challenging situations that arise in the future will be resolved satisfactorily. Surprisingly, universities do not employ ethics consultants. In this essay, I will explore the idea of university ethics consultants.

In this paper, I will argue for a complex of three theses. First, that the problem of deep disagreement is an instance of the regress problem of justification. Second, that the problem of deep disagreement, as a regress problem, depends on a dialecticality requirement for arguments. Third, that the dialecticality requirement is plausible and defensible.

Though textbook tu quoque arguments are fallacies of relevance, many versions of arguments from hypocrisy are indirectly relevant to the issue. Some arguments from hypocrisy are challenges to the authority of a speaker on the basis of either her sincerity or competency regarding the issue. Other arguments from hypocrisy purport to be evidence of the impracticability of the opponent’s proposals. Further, some versions of hypocrisy charges from impracticability are open to a counter that I will term tu quoque judo.

Suicide attack is the most virulent and horrifying form of terrorism in the world today. The mere rumor of an impending suicide attack can throw thousands of people into panic. This occurred during a Shi‘a procession in Iraq in late August 2005, causing hundreds of deaths. Although suicide attacks account for a minority of all terrorist acts, they are responsible for a majority of all terrorism-related casualties, and the rate of attacks is rising rapidly across the globe. During 2000–2004, there (...) were 472 suicide attacks in 22 countries, killing more than 7,000 and wounding tens of thousands. Most have been carried out by Islamist groups claiming religious motivation, also known as jihadis. Rand Corp. vice president and terrorism analyst Bruce Hoffman has found that 80 percent of suicide attacks since 1968 occurred after the September 11 attacks, with jihadis representing 31 of the 35 responsible groups. More suicide attacks occurred in 2004 than in any previous year, and 2005 has proven even more deadly, with attacks in Iraq alone averaging more than one per day, according to data gathered by the U.S. military. The July 2005 London and Sinai bombings, a second round of bombings at tourist destinations in Bali in October, coordinated hotel bombings in Jordan in November, the arrival of suicide bombings in Bangladesh in December, a record year of attacks in Afghanistan, and daily bombings in Iraq have spurred renewed interest in suicide terrorism, with recent analyses stressing the strategic logic, organizational structure, and rational calculation involved. Whereas they once primarily consisted of organized campaigns by militarily weak forces aiming to end the perceived occupation of their homeland, as argued by University of Chicago political scientist Robert Pape in Dying to Win: The Strategic Logic of Suicide Terrorism, suicide attacks today serve as banner actions for a thoroughly modern, global diaspora inspired by religion and claiming the role of vanguard for a massive, media-driven transnational political awakening. Living mostly in the diaspora and undeterred by the threat of retaliation against original home populations, jihadis, who are frequently middle-class, secularly well educated, but often “born-again” radical Islamists, including converts from Christianity, embrace apocalyptic visions for humanity's violent salvation. In Muslim countries and across western Europe, bright and idealistic Muslim youth, even more than the marginalized and dispossessed, internalize the jihadi story, illustrated on satellite television and the Internet with the ubiquitous images of social injustice and political repression with which much of the Muslim world's bulging immigrant and youth populations intimately identifies. From the suburbs of Paris to the jungles of Indonesia, I have interviewed culturally uprooted and politically restless youth who echo a stunningly simplified and decontextualized message of martyrdom for the sake of global jihad as life's noblest cause. They are increasingly as willing and even eager to die as they are to kill. The policy implications of this change in the motivation, organization, and calculation of suicide terrorism may be as novel as hitherto neglected. Many analysts continue to claim that jihadism caters to the destitute and depraved, the craven and criminal, or those who “hate freedom.” Politicians and pundits have asserted that jihadism is nihilistic and immoral, with no real program or humanity. Yet, jihadism is none of these things. Do we really understand the causes of today's suicide terrorism? Do suicide attacks stem mainly from a political cause, such as military occupation? Do they need a strong organization, such as Al Qaeda? What else could be done to turn the rising tide of martyrdom? (shrink)

In the debate over Spanish treatment of the natives of the New World, both sides regularly invoked Aristotle on natural slaves. This paper argues that the interpretation of the Spanish Dominican Domingo de Soto displays a greater understanding of Aristotle and the Aristotelian tradition of justice than that of Juan Gines de Sepúlveda, the Spanish Humanist. The paper goes on to argue that it is the humanist tradition itself that disposes Sepúlveda to misconstrue Aristotle and the tradition of political justice.

Pragmatism’s naturalism is inconsistent with the phenomenological tradition’s anti-naturalism. This poses a problem for the methodological consistency of phenomenological work in the pragmatist tradition. Solutions such as phenomenologizing naturalism or naturalizing phenomenology have been proposed, but they fail. As a consequence, pragmatists and other naturalists must answer the phenomenological tradition’s criticisms of naturalism.

People usually fail the Wason selection task, choosing P and Q cases, when attempting to validate descriptive rules having the form “If P, then Q.” Yet they solve it, selecting P and not-Q cases, when validating deontic rules of the form “If P, then must Q.” The field of evolutionary psychology has overwhelmingly interpreted deontic versions of the selection task in terms of a naturally-selected, domain-specific social-contract or cheating algorithm. This work has done much to promote evolutionary psychology as an (...) alternative to a mindblind sociobiology that ignores the computational structure of cognitive mechanisms in producing people's behaviors. Nevertheless, evolution-minded researchers outside cognitive psychology know little of the ample literature challenging this interpretation and uncritically cite the “cheater-detection module” as a key insight into human cognition. Although a priori arguments for a specially evolved cheater-detection module are plausible, the selection task provides no direct evidence for such a module. (shrink)

Upshot: I discuss further why my proposals may not be taken up by all and say more about their usefulness, my understanding of what it is to be a cybernetician and the underlying coherent form that I see amongst different “versions” of cybernetics. I also elaborate on what is social about psychosocial unities and elaborate their relevance for studies of social systems.

Epistemic infinitism is the view that infinite series of inferential relations are productive of epistemic justification. Peirce is explicitly infinitist in his early work, namely his 1868 series of articles. Further, Peirce's semiotic categories of firsts, seconds, and thirds favors a mixed theory of justification. The conclusion is that Peirce was an infinitist, and particularly, what I will term an impure infinitist. However, the prospects for Peirce's infinitism depend entirely on the prospects for Peirce's early semantics, which are not good. (...)
